German Law is very sane in regards to voting rights.

§ 13 of the German Federal Election Act (BWG) stipulates that only who is disenfranchised as a result of a judge’s decision is excluded from the right to vote.

This provision does not conflict with the general principle of equality in Article 3 of the Basic Law (Grundgesetz - GG) and the principles of equality and universality of the vote, because the right to vote is not automatically revoked, but may only be revoked by a judge’s ruling if certain legal requirements are met.

However, this exclusion as a result of a German court ruling is only possible in a few cases expressly mentioned in the Criminal Code (StGB) and the Federal Constitutional Court Act (BVerfGG) and applies for a maximum of two to five years. Exclusion from the right to vote applies if a person has been sentenced to at least six months or at least one year in prison for the following offenses, for example:

• Preparation of a war of aggression and high treason against the Federation
• Treason and disclosure of state secrets
• Attack against organs and representatives of foreign states
• Obstruction of elections and falsification of election documents
• Bribery of members of parliament
• acts of sabotage of means of defense or intelligence service endangering security (in this case, a prison sentence of at least one year is required).

In these cases, the deprivation of the right to vote is at the discretion of the court in accordance with the special criminal law provisions and is not an automatic consequence of the conviction for these criminal offenses.

Furthermore, the right to vote can be revoked by the Federal Constitutional Court due to the violation of fundamental rights.

The disenfranchisement from voting is btw. also the foundation that makes one ineligible to be elected.

According to the Federal Election Act, anyone who has German citizenship and is of legal age on the day of the election is electable. This does not apply to those who:

• have lost the right to vote and therefore their eligibility to be elected as a result of a court ruling or no longer have the capacity to hold public office
• is permanently dependent on a statutory caregiver / guardian
• or is in a psychiatric hospital due to a conviction

Für den kapitalistischen Wahnsinn habe ich mich gar nicht ausgesprochen. Bin voll bei dir wenn es darum geht auf umweltgerechte Ökonomie zu wechseln.

Finde es aber ganz schön Menschenverachtend von dir den Krieg in der Ukraine als “Verteidigung der marktradikalen Wachstumsideologie” hin zu stellen, denn das ist es nicht wofür die Ukrainer kämpfen, die kämpfen gegen einen autoritären Aggressor und dafür ihr Schicksal selbst zu bestimmen und nicht unter russokapitalistischer Knute für den Reichtum russischer Oligarchen ausgebeutet zu werden. Wenn du eine menschenwürdige Realität verteidigen willst, verstehe ich nicht was du dagegen hast ukrainische Frauen vor der Vergewaltigung durch russische Soldaten und ukrainische Kinder vor russischen Bomben und Luftangriffen zu schützen.

1. Selbst wenn wir das anderswo hinnehmen, macht es das nicht besser. “Entweder wir helfen überall oder wir helfen gar nicht” führt halt nur dazu gar nicht zu helfen. Das ist das selbe dumme Argument wie “Deutschland alleine kann den Klimawandel nicht aufhalten, also sollten wir es gar nicht erst versuchen”. Die Ukraine liegt uns im wahrsten Sinne des Wortes “näher” und ich bin froh dass wir, wenn wir schon woanders nicht helfen, es wenigstens dort tun. Und letztlich ist mir scheißegal aus welchen Gründen der industrielle Komplex und die westliche Politik diesen Krieg führen. Ob die das tun um den Brotkorb Europas zu sichern und sicher zu stellen dass wir in der EU nicht den Afrikanern das Getreide vom Weltmarkt weg fressen, ob die ihre wirtschaftlichen Verbindungen in der Ukraine stärken wollen oder da einen Nachkriegs-Wachstumsmarkt sehen, das tangiert mich peripher, denn letzten Endes will ich dass wir da helfen aus den Gründen die ich angeführt habe und deren Gründe beflecken meine Gründe nicht, noch machen sie meine Gründe falsch. Dass ich zufällig mit den Arschlochkapitalisten am selben Strang ziehe ist kein Problem für mich. Wenn deren Gier ausnahmsweise mal dabei hilft Menschenleben zu schützen ist mir das Recht.

Ganz zu schweigen davon, dass in der Ukraine nicht zu helfen auch nicht dabei hilft die Ausbeutung des Planetens zu verringern oder die marktradikale Wachstumsideologie auf zu halten. Wenn ich die Wahl habe zwischen russischem Oligarchenkapitalismus mit Unterdrückung, Invasion, Fremdherrschaft, Vergewaltigung und Mord oder westlichem Raubtierkapitalismus mit (zumindest positiven Ansätzen von) Demokratie, Selbstbestimmung, ohne Vergewaltigung und Mord durch einen Aggressor, dann wähle ich das zweite.

2. Da bin ich voll bei dir! Ausstieg aus fossilen Brennstoffen noch vorgestern! Den Russen den Verkauf abdrehen indem wir nix mehr konsumieren, toll. Können wir gleichzeitig machen mit der Aufrüstung und der Hilfe für unsere Nachbarn. Bringt uns nix wenn wir alles abschalten und dann Polen von Russland annektiert wird und die da alles wieder anschalten. Zivilisatorischen Fortschritt muss man aufbauen, und verteidigen.

Wir müssen die Ukrainer nicht Mord, Totschlag, Vergewaltigung, Diskriminierung und LGBTQ±Verfolgung aussetzen um aus fossiler Energie aus zu steigen, wir können das gleichzeitig machen.
